How to Build an AI Governance Framework for EU AI Act Compliance
The EU AI Act requires not just that individual AI systems meet technical standards, but that organisations have governance structures and processes in place to ensure ongoing compliance. A policy document sitting in a shared drive is not governance. Governance is operationalised when it is embedded in how decisions are made, how AI is procured, how risks are managed, and how people are held accountable.
Article 4 requires that providers and deployers of AI systems, and product manufacturers placing AI systems on the market, take measures to ensure that their staff and other persons dealing with AI systems on their behalf have a sufficient level of AI literacy, taking into account their technical knowledge, experience, education, and training. Chapter III Section 4 (Articles 26–30) sets out the obligations of deployers of high-risk AI, including governance-related requirements such as organisational measures, human oversight, and incident reporting.
Why Governance Must Be Operationalised, Not Just Documented
The most common failure mode in AI governance is producing documentation, such as an AI policy, a set of principles, or a governance charter, and treating the documentation as equivalent to compliance. It is not. A policy that no one reads, applies to no specific decisions, and has no enforcement mechanism provides legal cover in the same way a fire exit sign provides protection against fire: technically present, but not the thing that protects you when something goes wrong.
Effective AI governance means that when a developer wants to deploy a new AI integration, they are required to complete a risk assessment. It means that when a high-risk AI system produces an anomalous output, someone is notified and a defined response occurs. It means that the organisation knows what AI it is running, who owns each system, and what each system is doing. These properties come from processes and technical controls, not from written principles.
The Governance Policy: What It Must Cover
An AI governance policy provides the authoritative statement of what the organisation will and will not do with AI. It must be specific enough to guide real decisions. At minimum, it should address:
Scope
Which AI systems and activities are covered. Include all AI developed, procured, or deployed, including embedded AI in SaaS tools
Principles
Organisational commitments: safety, transparency, accountability, non-discrimination, human oversight, privacy. These must be operationally defined, not just listed
Prohibited uses
Internal list of AI uses the organisation will not pursue, informed by Article 5 and organisational risk tolerance. Specific is better than general
Risk tolerance
What level of residual risk is acceptable for different AI risk tiers, and what governance gates must be passed before high-risk AI is deployed
Roles and accountability
Who is responsible for AI governance centrally, and who is accountable for each individual AI system. Accountability must be assigned to named individuals
Compliance obligations
Reference to specific EU AI Act obligations and how the organisation will meet them. Link policy commitments to operational processes
Step-by-Step: Building an Operational AI Governance Framework
Define an AI Governance Policy
Draft an AI governance policy that covers the elements above. The policy should be approved by senior leadership, ideally the board or equivalent, to give it organisational weight. It should be reviewed annually and updated when the regulatory landscape changes, when the organisation's AI use changes materially, or when governance gaps are identified. Publish the policy internally so that all staff involved in AI development, deployment, or procurement are aware of it. Where relevant, make a version available externally to demonstrate governance commitment to customers, regulators, and partners.
Establish Roles and Responsibilities
Assign clear accountability for AI governance. The following roles are commonly required in organisations with significant AI use:

Build a Risk Management Process
Article 9 requires that providers of high-risk AI systems implement a risk management system as a continuous iterative process. The process must: identify and analyse known and reasonably foreseeable risks associated with each high-risk AI system; estimate and evaluate the risks that may emerge from the use of the system; adopt suitable risk mitigation measures; test the effectiveness of those measures; and review the process at each major update. Document the risk management process formally. It must be available to market surveillance authorities. For each high-risk AI system, maintain a living risk register that is updated throughout the system's lifecycle, not just at deployment.
Create and Maintain an AI Register
An AI register is the operational heart of AI governance: the authoritative, continuously maintained list of all AI systems, their risk classifications, their owners, and their compliance status. It is different from a static inventory. The register is a living document that reflects the current state of AI across the organisation and is actively used to manage governance obligations. Each entry in the register should link to the relevant compliance documentation for that system. The register should be accessible to governance and risk teams and must be updated whenever a new AI system is deployed, an existing system is materially changed, or a system is decommissioned.
Establish an AI Procurement Process
Every new AI system, whether built internally or procured from a third party, represents a potential new compliance obligation. Embed AI governance requirements into your procurement process: before any new AI system is contracted or deployed, require a risk classification assessment, assignment of an AI owner, documentation of intended use, and review of the vendor's own compliance posture (including whether they provide the instructions for use required by Article 13). For high-risk AI systems, the procurement process should include a mandatory compliance gate that cannot be bypassed. Third-party AI systems do not exempt deployers from their own obligations under the EU AI Act.
Implement Technical Foundations for Governance
Governance without technical controls is fragile. If your organisation does not have reliable visibility into what AI systems are running and how they behave, then no governance process can reliably detect failures or enforce policies. The technical foundations of effective AI governance include: continuous monitoring of AI system deployments and API integrations to detect new or changed systems; automated logging of AI inputs, outputs, and decisions for audit purposes; real-time alerting on anomalous AI behaviour or threshold breaches; and access controls that enforce which staff can deploy or modify AI systems. These are not optional enhancements. They are the substrate that makes governance processes trustworthy.
Train Staff on AI Literacy
Article 4 requires that staff dealing with AI systems have sufficient AI literacy. This is not a generic requirement for everyone in the organisation to understand what AI is. It is a targeted obligation for those who develop, deploy, oversee, or make decisions based on AI systems. For each role, define the minimum required AI literacy: AI owners need to understand the capabilities and limitations of their system, risk classification, and compliance obligations; oversight personnel need operational understanding of the system and the ability to assess its outputs; procurement staff need to understand how to identify and evaluate AI in vendor products. Document training programmes and completion records.
Review and Audit Governance Effectiveness
Governance must be tested against reality, not just audited against documentation. Schedule regular reviews that assess whether governance processes are functioning as intended: are risk classifications being kept current? Are oversight records being maintained? Are new AI systems going through the procurement gate? Are incidents being detected and reported? Supplement self-assessment with periodic independent reviews. Where gaps are identified, document corrective actions and track their completion. The audit trail of governance reviews and corrective actions is itself evidence of an effective governance programme when regulators inquire.
Governance and Technical Controls Must Reinforce Each Other
Knowing which AI systems exist, what they do, and how they behave in production is not achievable through governance processes alone. It requires technical visibility. Continuous monitoring of AI API traffic, automated logging of AI decisions, and real-time alerting on anomalous behaviour provide the data layer on which governance processes depend. Without this technical foundation, governance exercises are working from incomplete information, and compliance gaps may persist undetected until a regulator or incident surfaces them. Investing in technical observability is not separate from governance. It is what makes governance reliable.
The August 2026 Deadline: What Must Be in Place
The EU AI Act's full requirements for high-risk AI systems under Chapter III apply from 2 August 2026. By this date, organisations using or providing high-risk AI must have in place: a functioning AI register, documented risk classifications, technical documentation for high-risk systems, data governance processes, logging and auditability capabilities, human oversight mechanisms, post-market monitoring plans, and a governance framework underpinning all of these. The governance framework is not a deliverable that can be completed shortly before the deadline. It takes time to embed processes, train staff, and establish technical controls. Organisations that begin governance framework development in 2025 will be better positioned than those that wait.
